1. Acceptance of Terms

By downloading, accessing, or using HabitRise, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use HabitRise.

References to "HabitRise," "we," "us," or "our" mean the operator of the HabitRise app and website.

2. The Service

HabitRise provides tools for habit tracking, task completion, reminders, progress visibility, streaks, and motivation. HabitRise is intended to support personal productivity and wellness routines, but it does not guarantee any specific outcome, behavior change, health result, or productivity result.

3. Eligibility

You must be at least 13 years old to use HabitRise. If you are under the age of majority in your location, you may use HabitRise only with the consent and supervision of a parent or legal guardian.

4. Accounts and Device Access

You are responsible for maintaining control of the device, Apple ID, account credentials, and settings used with HabitRise. You agree to provide accurate information when needed and to notify us if you believe your access has been compromised.

5. Subscriptions, Purchases, and Billing

Paid features may be offered through auto-renewing subscriptions, free trials, promotional offers, or one-time purchases made through the Apple App Store. Billing is handled by Apple under Apple's applicable terms and payment policies.

HabitRise uses RevenueCat to manage subscription status and app entitlements. RevenueCat helps us determine whether premium access should be active, expired, restored, or otherwise updated.

We do not directly collect or store credit card numbers, debit card numbers, bank account details, or full payment credentials. Those details are processed by Apple and its payment systems.

6. Auto-Renewal, Cancellation, and Refunds

Subscriptions may automatically renew unless cancelled through your Apple ID/App Store account before the end of the current billing period. You can manage or cancel subscriptions in your Apple App Store subscription settings.

Refund requests are handled by Apple and are subject to Apple's refund rules. HabitRise cannot guarantee refunds and may not be able to issue refunds directly for App Store purchases.

7. Push Notifications and Reminders

HabitRise may send push notifications for reminders, task completion motivation, streak updates, or related app messages if you enable notifications. Notifications are provided for convenience and may be delayed, unavailable, or affected by device settings, network conditions, or operating system behavior.

You are responsible for any action or inaction based on reminders. HabitRise should not be used as the sole reminder system for critical, medical, safety, financial, legal, or time-sensitive obligations.

8. Acceptable Use

You agree not to:

• Use HabitRise for unlawful, harmful, fraudulent, abusive, or misleading purposes.
• Interfere with, reverse engineer, copy, modify, or disrupt the app or its systems except where allowed by law.
• Attempt to bypass subscriptions, purchase validation, entitlement checks, or security controls.
• Upload or transmit malicious code, spam, or content that violates another person's rights.
• Use HabitRise in a way that could damage, disable, overburden, or impair the service.

9. User Content and App Data

You retain ownership of habit names, task descriptions, notes, goals, and other content you create in HabitRise. You grant us a limited right to process that content solely to provide, maintain, support, secure, and improve HabitRise.

You are responsible for the content you enter and for keeping appropriate backups where needed. We are not responsible for lost, incomplete, or deleted data except where required by law.

10. Health and Productivity Disclaimer

HabitRise is not medical, mental health, financial, legal, or professional advice. The app is a general habit and productivity tool. If you need professional advice or assistance, consult a qualified professional.

11. Intellectual Property

HabitRise, including its design, branding, software, features, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership of HabitRise or any related intellectual property.

12. Third-Party Services

HabitRise may rely on third-party services such as Apple, RevenueCat, analytics providers, crash reporting providers, hosting providers, and notification services. Your use of those services may be subject to their own terms and privacy policies.

13. Service Changes and Availability

We may modify, suspend, discontinue, or limit any part of HabitRise at any time. We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, or permanent support for every feature.

14. Termination

We may suspend or terminate your access to HabitRise if you violate these Terms, create risk for the service or other users, misuse paid access, or if continued service is no longer commercially or technically practical. You may stop using HabitRise at any time.

15. Disclaimers

HabitRise is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

16. Limitation of Liability

To the fullest extent permitted by law, HabitRise and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption arising from or related to your use of HabitRise.

Where liability cannot be excluded, our total liability will be limited to the greater of the amount you paid for HabitRise in the three months before the claim or USD $50, unless applicable law requires otherwise.

17. Indemnity

You agree to defend, indemnify, and hold harmless HabitRise and its operators from claims, damages, liabilities, losses, and expenses arising from your misuse of HabitRise, violation of these Terms, or violation of another person's rights.

18. Apple App Store Terms

If you downloaded HabitRise from the Apple App Store, you acknowledge that these Terms are between you and HabitRise, not Apple. Apple is not responsible for HabitRise or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable.

19. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where HabitRise is operated, without regard to conflict of law principles, unless consumer protection laws in your location require otherwise.

20. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as updating the effective date, posting revised Terms, or providing in-app notice where appropriate. Continued use of HabitRise after changes become effective means you accept the updated Terms.
